XU Series Thermal Binding System One Year Guarantee

  1. Guarantee
    2. a) Peleman Industries Inc. warrants that such XU Series binding machines (“Product”) shall be free from defect in material and workmanship for a period of one (1) year beginning on the invoice date of the original purchase of the Product. This one year period is extended by each whole day that the Product is out of your possession for repair under this guarantee/warranty. The guarantee/warranty extends only to the original purchaser of the Product who can provide proof of purchase.
  2. Limitations
    3. a) Except as noted above, the parties agree that there is no guarantee/warranty of merchantability or of the fitness for a particular purpose or any other warranties by Peleman Industries, Inc., either expressed or implied, or any affirmation of fact or representation which extends beyond the description contained herein.

    b) In no event shall Peleman Industries Inc. be liable for incidental, indirect, special, punitive or consequential damages (including but not limited to lost profits, lost sales, or any other proximate damages) arising from or related to the purchase or use of this Product performance or failure to perform any provision or term of this agreement or in connection with the purchase, operation or use of the goods, whether due to a breach of contract, breach of warranty, the negligence of Peleman Industries, Inc., or otherwise.

    c) Some states do not allow exclusions or limitations of incidental or consequential damages, so the above limitation exclusion may not apply to you. The warranty gives you specific legal rights, and you may have other rights which vary from state to state.
  3. Remedy
    4. a) Peleman Industries, Inc. will repair or replace, at its sole option, any defective or nonconforming goods (or part thereof) that are covered hereof. Further, if Customer provides notice to Peleman Industries, Inc. that any binding machine (or part thereof) covered by the guarantee/warranty is broken or otherwise not functioning correctly, Peleman Industries, Inc. will make such repairs or provide such replacement without regard to the reason such binding machine (or part thereof) is broken or not functioning correctly NO QUESTIONS ASKED. If Peleman Industries, Inc. elects to replace a defective product or part thereof, the defective product or part thereof shall remain the sole property of Peleman Industries, Inc. Peleman Industries, Inc. retains the right to replace any original part with a technically similar repaired part. Peleman Industries, Inc. shall return to Customer the repaired or replaced product (or part thereof) at the charge and risk of Peleman Industries, Inc.
  4. Procedure
    5. a) Peleman Industries, Inc. does not guarantee/warrant uninterrupted or error-free operation of the Product. If a problem develops during the guarantee/warranty period, the purchaser shall call 1-800-864-2463 for guidance. A Peleman Industries, Inc. representative will assist the purchaser with troubleshooting, determine if an authorization number is appropriate, and provide further instructions. Authorization numbers will only be provided after completing the troubleshooting effort, and to those providing the serial number of the product and proof of purchase date (bill of sale). Any and all goods being returned to Peleman Industries, Inc. must be accompanied by a Return Authorization (RA) number. The RA number must be visible on the outside of the box and should also be included inside the box. In returning this Product for repair or replacement under this guarantee/warranty, postage, shipping transportation, insurance and delivery costs, is done at the charge and risk of Peleman Industries, Inc. The Customer must abide by shipping methods or carrier (if any) dictated by Peleman Industries, Inc. Returned Product must be delivered in either its original carton or a similar package affording an equal degree of protection. If it is determined that purchaser’s product is not covered by this warranty, Peleman Industries, Inc. may, at their discretion, offer repair service at the purchaser’s expense. Peleman Industries, Inc. is not responsible for Product returns that have not received proper authorization. If unauthorized Product is returned to Peleman Industries, Inc., it is done fully at the Customer’s charge and risk and Peleman Industries, Inc. may at their discretion, do with said Product as they choose, including but not limited to, returning Product to Customer (at Customer’s charge and risk) or disposing of Product.
